By accessing this website, creating an account, or purchasing membership access, you agree to be bound by these Terms.
If you do not agree with these Terms, you may not use this website or any services provided through it.
1. Eligibility and Acceptance of Terms
By accessing or using the Nightfall Publications website, you represent that:
• You are at least 18 years old
• You have the legal capacity to enter into this agreement
• You will comply with all applicable laws and these Terms
Your continued use of the website constitutes acceptance of these Terms.
2. Description of Services
Nightfall Publications provides:
• digital narrative content
• member-only publishing artifacts
• serialized storytelling and literary works
• membership communities and events
• premium collector editions and merchandise
Certain services require paid membership tiers that provide access to exclusive materials.
Nightfall reserves the right to modify or discontinue services at any time.
3. User Accounts
To access certain services, you may be required to create a user account.
You agree to:
• provide accurate account information
• maintain the confidentiality of login credentials
• notify us immediately of unauthorized access
You are responsible for activities occurring under your account.
Nightfall may suspend or terminate accounts that violate these Terms.
4. Membership and Payments
Certain areas of the platform require membership.
Membership may include:
• one-time access fees
• recurring subscription charges
• tier-based privileges
By purchasing membership, you authorize Nightfall Publications to charge your payment method according to the pricing disclosed during checkout.
Each tier has a one-time access fee, followed by a monthly or annual renewal at the rate shown at checkout. Renewals continue until you cancel. You may cancel anytime from your account; cancellation stops future billing and your access continues to the end of the period you have paid for. Fees are non-refundable except as stated in our Refund Policy. If you cancel and later rejoin, the access fee is due again.
Items saved to your Satchel remain there if you change membership tiers. If your account becomes past due, your member access—including access to your Satchel—is paused until your account is brought current.
If your membership ends, we will retain your account and saved Satchel items for 90 days, giving you time to return and restore your membership without losing what you saved. After that 90-day retention period, your account will be closed and your saved items will be permanently deleted.
Your membership ends when you cancel and your current paid membership period expires, or when your account remains continuously past due and your member access remains paused for 90 days without the account being brought current.
5. Intellectual Property
All content provided through Nightfall Publications is protected by intellectual property laws.
This includes:
• written works
• characters and narrative arcs
• artwork and visual assets
• brand elements and logos
• downloadable documents and media
Users may not reproduce, distribute, modify, or sell Nightfall content without written permission.
6. User Conduct
Users agree not to:
• violate applicable laws
• infringe intellectual property rights
• attempt unauthorized system access
• distribute malware or harmful code
• engage in harassment or abusive conduct
Nightfall may remove content or terminate accounts that violate these standards.
7. Third-Party Services
The platform may integrate with third-party providers such as:
• payment processors
• email delivery platforms
• infrastructure services
Use of those services is governed by their own policies.
8. Disclaimer of Warranties
Nightfall Publications provides services “as is” and “as available.”
We do not guarantee uninterrupted service or error-free operation.
9. Limitation of Liability
To the fullest extent permitted by law, Nightfall Publications shall not be liable for:
• indirect damages
• loss of profits
• loss of data
• service interruptions
Total liability will not exceed the amount paid for services within the prior twelve months.
10. Termination
Nightfall may suspend or terminate access if a user:
• violates these Terms
• engages in illegal activity
• disrupts the platform
Termination does not waive payment obligations already incurred.
11. Governing Law
These Terms are governed by the laws of the State of Texas, United States.
Any disputes will be resolved within the jurisdiction of Texas courts.
12. Changes to These Terms
Nightfall may update these Terms periodically.
Continued use of the platform after changes indicates acceptance of the updated Terms.
13. Copyright Protection and DMCA Policy
Nightfall respects the intellectual property rights of others.
Copyright complaints may be submitted under the Digital Millennium Copyright Act (DMCA).
Valid notices must include identification of the copyrighted work, the alleged infringement, and a statement made under penalty of perjury.
Nightfall may remove allegedly infringing material and terminate repeat offenders.
14. Event Participation and Ticket Purchases
Nightfall may host events related to publications or membership activities.
Event tickets are typically non-refundable, unless the event is canceled by Nightfall.
Nightfall may modify event schedules or formats when necessary.
Disruptive attendees may be removed without refund.
15. Collector Editions and Physical Products
Nightfall may sell limited-edition books and merchandise.
Refunds or replacements may be issued if:
• items arrive damaged
• manufacturing defects occur
• incorrect items are shipped
Requests must be submitted within 14 days of delivery.
16. Canon and Narrative Intellectual Property
The Nightfall narrative universe—including characters, storylines, and world-building elements—is protected intellectual property owned by Nightfall Publications.
Unauthorized reproduction or commercial use is prohibited.
17. User-Generated Content
Members may be able to create, upload, or share content within certain areas of the platform, including member spaces, profiles, or chat environments.
Users remain solely responsible for any content they submit.
Users agree not to upload or publish material that:
• violates intellectual property rights
• contains unlawful or harmful content
• harasses or threatens others
• promotes scams, malware, or illegal activity
Nightfall does not claim ownership of user content.
However, by posting content on the platform, users grant Nightfall a limited, non-exclusive license to host and display such content solely for operating the service.
18. Community Moderation Authority
Nightfall Publications reserves the right to moderate community activity in order to maintain a safe and respectful environment.
Authorized moderators may:
• remove user-generated content
• restrict member spaces
• suspend user privileges
• terminate accounts for repeated violations
Moderation decisions are made at Nightfall’s discretion to protect the integrity of the platform and its community.
19. Arbitration and Dispute Resolution (Optional)
Disputes arising from these Terms may be resolved through binding arbitration under the rules of the American Arbitration Association.
Arbitration shall occur within the State of Texas unless otherwise required by law.
